Fitmy is currently in beta/testing phase. The service is provided "as is" without any warranties of any kind. There is a real possibility that the service may not work correctly, may produce inaccurate results, or may be unavailable at times.

AI-generated content is not medical advice. Meal plans, workout programs, calorie targets, and health recommendations generated by our AI may be incorrect, unsuitable for your individual situation, or potentially harmful if followed without professional guidance.

By using Fitmy, you acknowledge and agree that: (1) You use the service entirely at your own risk. (2) Fitmy and its operators are not responsible for any health outcomes, injuries, financial losses, or other damages resulting from use of the service. (3) You will consult qualified professionals before making health decisions.

1. Acceptance of Terms

By accessing or using Fitmy ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms may be updated at any time without prior notice.

2. Beta Service Status

Fitmy is currently in beta testing. This means:

Features may be incomplete, buggy, or subject to change without notice
AI-generated content may contain errors, inaccuracies, or inappropriate recommendations
The service may experience downtime, data loss, or unexpected behavior
We make no guarantees about the accuracy or reliability of any content

3. Health and Fitness Disclaimer

IMPORTANT: The fitness and nutrition information provided by Fitmy, including AI-generated meal plans, workout programs, calorie recommendations, and health advice, is for general informational and educational purposes only.

This information is NOT a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition or before starting any new diet or exercise program.

Fitmy expressly disclaims all responsibility for any adverse effects, injuries, or health consequences that may result from following AI-generated recommendations. Individual results will vary. What works for one person may not work for another and could potentially be harmful.

4. Limitation of Liability

To the maximum extent permitted by applicable law, Fitmy and its operators, employees, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to:

Physical injury or health complications from following AI recommendations
Loss of data or progress information
Service interruptions or unavailability
Inaccurate, incomplete, or misleading AI-generated content
Any other damages arising from use of the service

5. Subscription and Payments

Subscriptions are billed through Stripe. The 3-day free trial requires a valid payment method. You will be charged after the trial period unless you cancel. Refunds are handled on a case-by-case basis — contact us within 7 days of a charge for refund requests. We reserve the right to change pricing at any time with reasonable notice.

6. User Responsibilities

You are responsible for:

Providing accurate information during onboarding
Using the service in a lawful manner
Not sharing your account credentials
Consulting healthcare professionals before acting on AI advice
Any content you post in community features

7. Termination

We reserve the right to suspend or terminate your account at any time for violation of these terms or for any other reason at our discretion. You may delete your account at any time from the Profile page.

8. Governing Law

These terms are governed by applicable law. Any disputes shall be resolved through good-faith negotiation first. If unresolved, disputes shall be subject to binding arbitration.
